Apple is not evil. Apple good. Yummy Apple.

from the original court documents that were summarized incorrectly by the post you referred to, nate:
"Psystar purchases computer components from third parties and assembles them. (Psystar Br. at 9.) Psystar then loads onto those computers Apple's Mac OS X software, which Psystar modifies with its "own software" to "add features ... to get OS X Leopard to work on a wider range of computers than simply Apple Macintoshes." (Id. at 9, 11.)"
IMO Psystar has been openly asking for trouble ever since they started trying to sell Hackintoshes. Of course theres extensive documentation (for example:
http://osx86.sojugarden.com/) on installing OSX on PC's- its been entirely possible ever since OSX became Intel-compatible. However, the hackers posting the how-tos probably never expected someone to take their kernel hacks and try to
openly retail OSX on their home-built hackintoshes. It's like, "no one could be that stupid... right?" Go look at Psystars' website, and see what you think their intentions are.
Oh come on. Any company has the right and duty to defend itself from blatant, stupid (see above) piracy. And after reading Psystar's idiotic response to the above, my sympathy is entirely with Apple.
